Terms of Service
These Terms of Service (the Terms) form a binding legal agreement between you (you, your, the user) and the Velocity team (we, us, our, Velocity). They govern your access to and use of Velocity, a one-click PC optimizer for Minecraft and other games, together with our website, desktop applications, downloads, accounts, and all related content and services (collectively, the Service). Please read these Terms carefully and keep a copy for your records. By creating an account, downloading, installing, accessing, or otherwise using any part of the Service, you acknowledge that you have read and understood these Terms and that you agree to be bound by them. If you do not agree with any part of these Terms, you must not access or use the Service.
1 Definitions
To make these Terms easier to read, the following words have the meanings set out below wherever they appear with an initial capital letter:
- Account means the personal account you create to access, license, and download Velocity.
- Service means the Velocity software, website, applications, downloads, updates, accounts, documentation, and any related services we provide.
- Content means all text, graphics, logos, software, and other materials that form part of the Service.
- Tier means a specific level of Velocity (for example Free, Standard, or Premium) with its own set of features and, where applicable, its own price.
- Device means a computer on which you install or run Velocity.
2 Acceptance of terms
By downloading, installing, accessing, or using Velocity, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Service.
You must be old enough to form a binding contract where you live, or have permission from a parent or guardian, to use the Service. If you are using Velocity on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
3 Your account
Some parts of the Service require an Account. When you create an Account, you agree to provide accurate and complete information and to keep it up to date. You are responsible for choosing a strong password and for keeping your login credentials confidential.
You are responsible for all activity that happens under your Account, whether or not you authorized it, unless the activity resulted from our failure to take reasonable security measures. You agree to notify us promptly at [email protected] if you believe your Account has been accessed without your permission. We are not liable for any loss arising from unauthorized use of your Account that results from your failure to safeguard your credentials.
4 The license you get
When you buy a paid tier of Velocity, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Velocity on your own computers for your own use. Your purchase is a one-time payment, not a subscription, and your license does not expire on a timer.
Lifetime updates means you receive the updates we release for the version and tier you bought, for as long as we keep maintaining that product. It does not promise that any specific feature, game, or platform will be supported forever.
The license is for personal use. You may not resell, rent, sublicense, or share your license or account with other people, and you may not copy, decompile, reverse engineer, or try to extract the source of Velocity, except where a law gives you a right we cannot restrict. We keep all rights we do not expressly grant to you.
5 Payment and billing
Paid tiers are sold as a single, one-time payment. We do not run subscriptions and will not charge you on a repeating schedule for the tier you purchased. Prices are shown on our pricing page and may change over time, but a price change does not affect a purchase you have already completed.
Payments are handled by our third-party processors: Stripe for card payments and NOWPayments for cryptocurrency. When you pay, you also agree to the terms of the processor you use. We do not receive or store your full card number or your crypto wallet credentials. You are responsible for any taxes that apply to your purchase unless we state otherwise.
6 Refunds
Please choose carefully before you buy. To be clear: Velocity does not offer a money-back guarantee, and paid purchases are generally non-refundable, except where a refund is required by law.
Because results depend on your hardware and setup, we offer a free tier so you can try Velocity on your own PC before you pay for a higher tier. We encourage you to use the free tier first to confirm that Velocity works the way you expect. Where your local consumer law gives you a mandatory right to a refund or cancellation, nothing in these Terms takes that right away.
7 Acceptable use
You agree to use Velocity only for lawful purposes, and only on computers you own or are allowed to manage. You agree not to:
- use the Service in violation of any law or of another person's rights;
- bypass license checks, share or resell access, or use one license across more computers than your tier allows;
- interfere with, disrupt, probe, or overload our systems or the Service;
- upload or distribute malware, or use Velocity to damage another person's device;
- misrepresent Velocity as your own product, or remove our notices and credits.
We may suspend or end your access to the Service if you break these rules or put other users or our systems at risk.
8 Updates, changes, and availability
We are continually improving Velocity. We may add, change, or remove features, games, or platform support at any time, and we may release updates, patches, and new versions. Where an update is important for security, stability, or licensing, we may require you to install it in order to keep using the Service.
We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Access may be affected by maintenance, updates, technical problems, or factors outside our control, including your own hardware, software, and internet connection. We may modify or discontinue any part of the Service, temporarily or permanently, and we will try to give reasonable notice of significant changes where we can.
9 Third-party services
The Service relies on, and may link to, services operated by third parties, including our payment processors (Stripe and NOWPayments), our community platform (Discord), and content platforms such as YouTube. Your use of those third-party services is governed by their own terms and privacy policies, and we are not responsible for their content, practices, or availability. Any names, logos, or trademarks of third parties shown in the Service belong to their respective owners and are used only for identification and compatibility.
10 Intellectual property
The Service, including Velocity itself, our website, our name, our logo, and all associated Content, is owned by us or our licensors and is protected by copyright, trademark, and other laws. Except for the limited license granted to you in these Terms, nothing here transfers any ownership or intellectual property rights to you.
The Velocity name and logo are our trademarks. You may not use them without our prior written permission, except to refer to the Service fairly and accurately. All feedback, suggestions, and ideas you send us about the Service may be used by us without any obligation or compensation to you.
11 The software is provided as-is, and results vary by hardware
Velocity is provided on an as-is and as-available basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Velocity adjusts settings on your computer to improve performance. Real results vary widely, including frames per second, latency, load times, and stability, depending on your hardware, drivers, operating system, other software, and the specific game. We do not promise any particular performance gain, and any example figures shown on our site are illustrations, not guarantees.
Velocity is designed to be safe and reversible and to create a restore point before it makes changes, but you remain responsible for keeping your own backups and for the overall state of your system. To the maximum extent permitted by law, we disclaim all warranties relating to the Service.
12 Limitation of liability
To the maximum extent permitted by law, Velocity and the people who operate it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or related to your use of, or inability to use, the Service.
To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you actually paid us for Velocity in the twelve months before the event that gave rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13 Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Velocity and the people who operate it from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
14 Termination
You may stop using the Service and close your Account at any time. We may suspend or terminate your access to the Service, in whole or in part, if you breach these Terms, if we are required to do so by law, or if we reasonably believe your use puts other users, third parties, or our systems at risk.
On termination, the license granted to you ends and you must stop using and, where relevant, remove Velocity. Sections of these Terms that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will continue to apply.
15 Not affiliated with Mojang or Microsoft
Velocity is an independent product. We are not affiliated with, endorsed by, sponsored by, or associated with Mojang, Microsoft, or any game publisher. Minecraft is a trademark of Mojang and Microsoft, and all other game names, trademarks, and logos belong to their respective owners. We use these names only to describe compatibility.
16 Changes to these terms
We may update these Terms from time to time, for example to reflect new features, legal requirements, or changes to how the Service works. When we make a material change, we will update the Last updated date at the top of this page and, where appropriate, give additional notice.
Your continued use of the Service after a change takes effect means you accept the updated Terms. If you do not agree with a change, please stop using the Service.
17 Governing law and disputes
These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection laws of the country in which you live that cannot be excluded by agreement.
Before starting any formal proceeding, we ask that you first contact us so we can try to resolve the matter informally. Nothing in these Terms limits any right you may have to bring proceedings in your local courts where the law gives you that right.
18 General provisions
- Entire agreement. These Terms, together with our Privacy Policy and any tier-specific terms shown at purchase, are the entire agreement between you and us about the Service.
- Severability. If any part of these Terms is found to be unenforceable, the rest will remain in full effect, and the unenforceable part will be applied to the maximum extent permitted by law.
- No waiver. If we do not enforce a right or provision, that is not a waiver of that right or provision.
- Assignment. You may not transfer your rights under these Terms without our consent. We may assign our rights and obligations, for example as part of a merger, acquisition, or sale of assets.
- Headings. Section titles are for convenience only and do not affect how these Terms are interpreted.
